Disclaimer of Liability
Firezat Inc., its employees,
management, directors, consultants, vendors, distributors, contractors
and manufactures make no claims or statements, or offer any assurance
or assurances, guarantees, promises, either direct or implied, as to
the effectiveness or suitability of its products to protect any
property or possessions from fire damage or any other calamity whether
anticipated or foreseen. Firezat, Inc. and its suppliers and vendors
disclaim all express or implied representations or warranties regarding
the information, services, products, materials, and any other resources
available on or accessible through this site or via direct contact with
the company, including (without limitation) any implied warranties of
merchantability or fitness for a particular purpose. All such
information, services, products, information, opinions, materials, and
other resources are made available "as is" and "as available" without
warranty of any kind. Property damage up to and including total
destruction of the structure or property being covered may occur even
under the best conditions. Firezat shall not be liable for any loss,
injury or death or any direct or indirect damages arising out of the
deployment of, or use of, its products.
Firezat,
Inc. believes the information herein is the best currently available.
It is subject to revision as additional knowledge and experiences are
gained. Firezat, Inc. makes no guarantees of results and assumes no
obligation or liability in connection with this information or the use
of its products.
There are uses and environments for which these products are
unsuitable. Due to the extreme conditions, high heat, high winds, low
humidity, and unpredictability associated with all fires it is
impossible to make guarantees. It is the user's sole responsibility to
determine that this product is appropriate for the intended use and
complies with the health and safety laws and regulations. Before
using, the user agrees to assume all risks and liabilities in
connection with deployment, application, take-down, use and/or storage
of Firezat Fire Shields. Sellers and manufacturers
only obligation shall be to replace any Fire Shields found to be
defective within one year from the date of purchase.
As a condition of any sale the Customer agrees and accepts all
conditions, requirements, limitations, and terms as stated in the
Firezat Disclaimer document and the Firezat Limitation of Liability
statement located on the company website and on the company sales
invoice, and agrees and understands that acceptance of these conditions
are required and mandatory in order to conduct business with Firezat or
its suppliers and vendors.
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE
LAW, WITH RESPECT TO PRODUCTS, GOODS, OR SERVICES PURCHASED THROUGH
FIREZAT.COM OR FROM FIREZAT INC., OR FROM ITS SUPPLIERS OR VENDORS, IN
NO EVENT SHALL FIREZAT, INC., OR ITS SUPPLIERS OR VENDORS, BE LIABLE
FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, EXEMPLARY, OR
CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER, RESULTING FROM ANY
LOSS OF USE, LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION,
RELOCATION EXPENSE, INSURANCE DEDUCTIBLE OR PREMIUMS, LITIGATION, OR
ANY OTHER PECUNIARY LOSS, WHETHER BASED ON BREACH OF CONTRACT, TORT
(INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR OTHERWISE ARISING OUT OF
OR IN ANY WAY CONNECTED WITH THE USE OF OR PERFORMANCE OF ITS PRODUCTS
OR INFORMATION, WITH THE DELAY OR INABILITY TO DELIVER PRODUCTS TO THE
CUSTOMER, OR THE DEPENDENCE ON THIRD PARTIES TO PROVIDE DELIVERY
SERVICE TO THE CUSTOMER OR THE PROVISION OF OR FAILURE TO MAKE
AVAILABLE ANY SUCH PRODUCTS, GOODS, OR SERVICES, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
You acknowledge and agree that the limitations set forth above are
fundamental elements of this agreement and the site and products or
services would not be provided to you absent such limitations.
Conditions of Use
Always obey fire, police, and all other emergency personnel when
ordered or requested to evacuate an emergency area immediately.
Use extreme caution when walking on shields
that are wet or walking on dry shields with wet shoes. SHIELDS ARE
EXTREMELY SLIPPERY AND DANGEROUS WHEN WET. Use safety ropes and
harnesses if working on roofs.
Firezat does not encourage homeowners to climb on the roof of any
structure and provides information on how to deploy without mounting
roofs or leaving the ground. Always use caution if walking or standing
on a roof, ledge or using a ladder. Firezat recommends testing
all roofs for structural integrity before walking on them.
Avoid contact of the fire covers with all
power lines and cables attached to structures. Use extreme
caution when deploying in high wind situations especially when working
near power lines, windows, vehicles, on roofs, or on ladders, or
scaffolding. Beware of potential damage due to wind blowing the shields
causing them to strike property and cause damage.
Be aware that winds can and will increase during a fire and can reach
speeds of 40 MPH or more. When covering a roof surface it is imperative
that no seams or edges are open that can allow fire material to enter
under the cover and cause ignition. Seal ALL seams using shield bands,
nails, sandbags, or other weighted material that cannot be dislodged by
high winds. It is imperative that the edges of the tarps are secured
either to the structure or wrapped around the structure and secured to
prevent wind from dislodging the edges. See the product instructions

Due to the high reflective characteristics of the Aluminized material
avoid looking at the material when possible on sunny days without
proper eye protection. Firezat recommends wearing protective dark
glasses when installing Fire Shields during daylight hours.
